The Ark Grotto Terms and Conditions 2014

  1. The Ark Christmas Grotto operates from Thursday 27th November to Wednesday 24th December 2014 inclusive. For certain dates there may be a restriction on the maximum number of The Ark Christmas Grotto e-tickets ("Grotto e-Tickets") that may be purchased. You are recommended to book early to avoid disappointment.
  2. We treat individuals as part of a “Group” based on time slots.
  3. For the purposes of The Ark Grotto and these Terms and Conditions, a “Child” is someone aged between 12 months and 14 years.
  4. Each full paying Child will receive a gift from Father Christmas.
  5. Babies – children under 12 months of age visit free with older siblings when as an Observer status (i.e. they do not participate in activities or receive a gift from Father Christmas).
  6. The Ark Grotto timings, craft activity and visit to Father Christmas is at the sole discretion of our management.
  7. Smoking is not permitted anywhere in The Ark Grotto
  8. Pets or other animals may not be brought to The Ark Grotto (except guide or hearing dogs).
  9. We will use reasonable endeavours to ensure The Ark Grotto is a happy and memorable one for you and your guests for all the right reasons, however we cannot be liable for distress caused beyond our control nor for any emotional distress or disappointment caused by the role playing of characters (including, without limitation, if any Child (or Adult) loses his or her belief in Father Christmas for any reason as a result of visiting The Ark Grotto).
  10. The Ark Christmas Grotto will charge a £12 ticket fee per child and a booking fee of £xx applies to all transactions to cover the costs of processing credit/debit card transactions securely on the internet.
  11. Your Grotto e-Ticket cannot be refunded, exchanged, resold, transferred or redeemed for cash. The Grotto e-Ticket is for your personal use only. The Ark reserves the right to cancel Grotto e-Tickets that have been transferred or resold in its absolute discretion. Lost tickets cannot be replaced.
  12. Acceptance of your Grotto e-Ticket confirms your agreement to these terms and conditions.
  13. To enter The Ark Grotto, you must present a valid Grotto e-Ticket at the time of arriving at The Ark and at The Ark Grotto. An adult must accompany all children up to and including 14 years of age.
  14. Please ensure you and your guests arrive on time at The Ark for your allocated Grotto booking, as late arrivals will not be accepted and the ticket and amount you have paid will be forfeited.
  15. The use of personal photography and video recording equipment (including mobile phones) is strictly prohibited when with Father Christmas.
  16. The Ark reserves the right to refuse admission to The Ark Christmas Grotto and to change these terms and conditions at any time.
  17. Standard wheelchair access is available in The Ark Grotto. Please note motorised electric scooters cannot be permitted.
  18. Pushchairs are not permitted into The Ark Grotto.
  19. Details of your name and address are recorded, held on computer and may be used for updating you with information from The Ark. These records are for The Ark’s sole use. Under the terms of the Data Protection Act, you have the right to advise us at anytime if you do not wish to receive further contact from The Ark.
  20. To the maximum extent permitted by law, neither we nor any of our directors, employees or other representatives will be liable for any of the following loss or damage (however arising and whether such losses were foreseeable or note)
    20.a Loss of data
    20.b Loss of profit
    20.c Loss of revenue
    20.d Loss of business or opportunity
    20.e Loss of goodwill
    20.f Disappointment or emotional distress and/or an indirect, consequential or special loss arising in connection with The Ark Grotto or provision of our services to you 
  21. Transaction concluded through 3rd party booking website.  Any purchases made via the website will be governed by the terms and conditions of that site.  Viruses, hacking and other offences – you must not misuse out website or attempt to make any unauthorised use of it e.g. knowingly introducing viruses, Trojans worms, logic bombs or any other material which is malicious or technologically harmful to The Ark or related third party sites. 
  22. We will not be liable for any loss of damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, data, programs due to the use of The Ark website or from downloading any material from our website or e-mail communications. 
  23. Force Majeure includes the following:
    a Fire, explosion, flood, storm, earthquake, subsidence, epidemic or other natural disasters.
    b Strikes, lock-outs or other industrial action
    c Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not)or threat or preparation for war
    d. Impossibility of the use of public or private telecommunications network
    e. The acts, decrees, legislation, regulations or restrictions of any government 
  24. Nothing in these Terms and Conditions shall exclude or in any way limit our liability for death or personal injury caused by our negligence, fro fraud or fraudulent misrepresentation or for any liability, which cannot be excluded or limited by law.

Complaints
Sometimes, despite every effort being made to ensure you have anenjoyable experience, things may go wrong. 

If before or during the Experience You have a complaint in relation to the Experience please contact the Promoter or a Duty Manager in The Ark promptly since complaints are very difficult to deal with after the Experience
